Chapter 7 Bankruptcy

Ventura County Bankruptcy Lawyers - Thousand Oaks and Ventura Offices

If you are struggling financially or cannot meet your monthly obligations, the federal bankruptcy laws can help you stop threatening phone calls and letters and even stop foreclosure, so that you can get on your way to  a fresh start. Chapter 7 bankrucpty allows you to discharge certain tpyes of  debt, and allows you to restructure your financial lfie. Filing for bankruptcy is an important decision, Van Sickle and Assosiates can guide you through the bankruptcy process.

Chapter 7 bankruptcy is a debt relief option focused on eliminating or liquidating unsecured debts, including medical expenses and credit card bills. Pursuing Chapter 7 bankruptcy allows you and your family to wipe the slate clean and take the right steps towards debt freedom. Attorneys at Van Sickle and Asociates have helped many people in Southern California obtain consumer debt relief through Chapter 7. If it is the right solution for you, our firm can act immediately to end creditor harassment, the threat of repossession, foreclosure, and wage garnishment, and begin the process of debt relief.

The Bankruptcy Means Test

Before a bankruptcy petition can be filed with the bankruptcy court, in most cases the filer has to pass the means test, which is set of guidlines that must be met.  To find out whether a consumer can cancel qualifying debt under Chapter 7, the consumer must first calculate his/her current monthly income. This figure must be compared to the median income for the size of the consumer’s household in California. If the current monthly income is higher than the median income in California, the filing of the bankruptcy petition will be presumed to be an abuse of the bankruptcy process unless the consumer can show that they passed the means test.

The Chapter 7 Bankruptcy Process

It all starts with a free consultation at our office. We can review your situation, apply the means test, decide if filing for bankruptcy is right for you. Should you choose to file, we can begin the paperwork and enroll you in credit counseling (credit counseling in required by the federal bankruptcy code, and we can help with setting up in-person, over-the-phone, or internet-based credit counseling).  We will file your paperwork and represent you in court for your proceedings.  From start to finish, we are there to answer any questions.
